Terms of sale
These General Terms and Conditions of Sale (GTC) apply to all orders placed on the caracolito-chouchou.com website for the purchase of handmade products. By placing an order, the customer unconditionally accepts these GTC.
1. Seller Identification
The caracolito-chouchou.com website is operated by Sawsan MEJRI, a self-employed entrepreneur, whose business address is located at 50 avenue François Mitterrand, 91200 - ATHIS-MONS. You can contact her by phone at 0613604548 or by email at the following address: contact@caracolito-chouchou.com. The company's SIRET number is 84503186300010, and the intra-community VAT number is not applicable to VAT.
2. Products
The products sold on the caracolito-chouchou.com website are handcrafted creations. Each item is unique and may exhibit natural variations due to the artisanal manufacturing process. Product photos are provided for informational purposes only, and slight differences may exist between the photos and the actual products.
3. Scope of Application
The Site is freely accessible and free of charge to all Internet users. Browsing the Site implies unreserved acceptance of these General Terms and Conditions of Sale (GTC) by all Internet users. Simply connecting to the Site, by any means whatsoever, including through a robot or a browser, will imply full acceptance of these GTC.
When registering or ordering on the Site, this acceptance will be confirmed by the Internet user by checking the corresponding box.
The Internet user acknowledges having fully read these GTC and accepts them without restriction or reservation.
Checking the above box will be deemed to have the same value as a handwritten signature on the part of the User. The User acknowledges the evidentiary value of the Site's automatic recording systems and, unless proven otherwise, waives the right to contest their validity in the event of a dispute.
These General Terms and Conditions apply exclusively to the relationship between the User and Caracolito, to the exclusion of all other conditions, including those of the User.
Acceptance of these general terms and conditions presupposes that the User has the necessary legal capacity to do so, or, failing that, that they have the authorization of a guardian or curator if they are incapable, of their legal representative if they are a minor, or that they hold a power of attorney if they are acting on behalf of a legal entity.
4. Prices
Product prices are indicated in euros (€), inclusive of all taxes (TTC), unless otherwise indicated. Delivery costs are added to the total order amount and are calculated at the time of shopping cart validation, based on the delivery address.
The seller reserves the right to modify its prices at any time. However, products will be billed based on the prices in effect at the time the order is placed.
5. Orders
Orders are placed online via the caracolito-chouchou.com website. The customer must follow the online ordering process and confirm their order by clicking the "Order" button after verifying the order details.
Once the order is confirmed, a confirmation email will be sent to the customer, summarizing the products ordered, the total amount, and the estimated delivery time.
The seller reserves the right to refuse an order if there is any doubt about the validity of the order or payment, or if the customer has not complied with these Terms and Conditions.
The customer will receive an electronic invoice after each payment. The customer expressly agrees to receive invoices electronically.
6. Payment
Payment for products is made by credit card, Stripe, or PayPal. The customer guarantees that they have the necessary authorization to use the chosen payment method. In the case of payment by credit card, the debit is made at the time the order is confirmed.
The payment dates agreed for orders on the Caracolito-Chouchou website cannot be delayed under any circumstances, including in the event of a dispute.
Any amount not paid by the due date will automatically and without prior formal notice result in the application of late payment penalties calculated based on a rate equal to three times the legal interest rate, without this penalty affecting the due date of the principal amounts due.
In addition, any late payment will result in the invoicing of a recovery fee of €40, as well as the immediate payment of all remaining amounts due, regardless of the initially agreed deadlines. These amounts will be increased by a 20% penalty clause.
This penalty clause complies with the provisions of Article 1152 of the Civil Code, which allows the judge to reduce the compensation if the latter considers it excessive.
In the event of non-payment, Caracolito-Chouchou also reserves the right to unilaterally terminate the order and suspend the supply of products or services, at the Customer's initiative, without prejudice to other legal remedies available.
7. Delivery
Products are shipped to the delivery address provided by the customer when placing the order. Delivery times vary depending on the delivery address and the shipping method chosen. Order processing times are 5 business days from receipt of payment and 10 business days for custom-made products.
Shipping costs are calculated based on weight and destination.
The seller cannot be held responsible for delays or problems occurring during delivery. Risks associated with delivery (loss, theft, damage) are borne by the customer upon shipment of the products.
8. Returns and Exchanges
Since our products are handmade and often unique, we do not accept returns except in the case of a defective product or non-compliance with the order. In the event of a defective or damaged product, the customer must contact the seller at the following email address: contact@caracolito-chouchou.com within 3 days of receiving the order.
The product must be returned in its original condition and in its original packaging. Return shipping costs are the seller's responsibility in the event of a defective or non-compliant product.
9. Customer Service

In the latter two cases, the Publisher undertakes to provide a response within 2 days.
10. Right of Withdrawal
In accordance with legal provisions, the customer has a 14-day right of withdrawal from the date of receipt of the product, without having to provide a reason or pay any penalties, with the exception of return shipping costs. The customer must notify their decision to withdraw to contact@caracolito-chouchou.com before sending the product.
The product must be returned in its original condition and in its original packaging. Return shipping costs are the customer's responsibility.
11. Personal Space
Before placing any order on caracolito-chouchou.com, it is necessary to create a personal space. To do this, the user will need to provide certain personal information, some of which is required to create an account. If the User chooses not to provide this information, it will be impossible to create a personal account and confirm the order.
When creating this account, the User must choose a password. This password guarantees the security and confidentiality of the data contained in the personal account. The User agrees to keep this password confidential and not to disclose it to third parties. Caracolito cannot be held liable for unauthorized access to the personal account due to the User's negligence in managing their login details.
The personal account allows the Customer to view their order history, information relating to purchased products, and delivery details.
Caracolito undertakes to secure the contractual data stored in accordance with the law or regulatory obligations.
In the event of non-compliance with the general terms and conditions, or if inaccurate or fraudulent information is provided, Caracolito reserves the right to delete a Customer's account. An account may also be deleted if it remains inactive for more than one year. This deletion will not be considered a breach on the part of Caracolito, and the Customer may not, under any circumstances, claim compensation for this deletion.
12. Intellectual Property
All elements of the caracolito-chouchou.com website (texts, images, logos, handcrafted creations, etc.) are the exclusive property of Sawsan MEJRI and are protected by intellectual property laws. Any reproduction or use of the website's elements without prior authorization is prohibited.
13. Protection of Personal Data
In accordance with the French Data Protection Act of January 6, 1978, and the General Data Protection Regulation (GDPR), the personal data collected during the order process is required for processing the order. 14. Liability
